The Legality of Online Gambling in the US

Some have argued that federal laws can be unconstitutional if they violate the Commerce Clause, which guarantees freedom of speech. But these attacks have so far been unsuccessful.
In 1999, a bill called the Internet Gambling Prohibition Act was introduced to the Senate. It would have made it illegal to gamble on the Internet for U.S. citizens. In 2007, Congressman Barney Frank introduced HR 2046, a bill that would amend UIGEA. It would also require internet gambling facilities to be licensed by the director of the Financial Crimes Enforcement Network. While this legislation has not passed, several similar bills have been introduced in the House.
The US Department of Justice has ruled that the Wire Act applies to all forms of Internet gambling. It has also seized $3.2 million from a Discovery Communications company, a firm that accepted advertisements from a Costa Rican casino operation.
Although a few states have legalized online gambling, most of the US still has strict restrictions on it. Some of these regulations include the use of a secure web address, a padlock symbol on a webpage, and the creation of a user profile that contains no personal information.
The United States has been criticized for enforcing its gambling laws in the face of the First Amendment. For instance, the founders of three of the largest online poker companies are currently being charged with violating the Unlawful Internet Gambling Enforcement Act. There have been other cases brought against gambling operators, including Seals with Clubs, a Bitcoin poker site that is operating in the United States.
